IPC Section 124A. Sedition (In a Nut Shell)

As Written

Whoever, by words, either spoken or written, or by signs, or by visible representation, or otherwise, brings or attempts to bring into hatred or contempt, or excites or attempts to excite disaffection towards The Government established by law in India shall be punished with imprisonment for life, to which fine may be added, or with imprisonment which may extend to three years, to which fine may be added, or with fine.



Points To Note

  1. Doing bad things (by means mentioned above) against India is not punishable rather doing bad against established Government is punishable.
  2. You can do anything against India but not against established Government.
  3. This law is 140 yrs old and was introduced in 1870 by British Goverment.
  4. Dr Binyak Sen is a recent victim of this law. When he was charged, he didn't even know what the term sedition meant. He asked, and the judge answered: ‘Rajdroh'.
  5. Mahatma Gandhi in 1922 was charged with same law. He called Section 124A the “prince among the political sections of the Indian Penal Code designed to suppress the liberty of the citizens”. “Affection,” he said, “cannot be manufactured or regulated by law.”

“I hold it to be a virtue to be disaffected towards a government which in its totality has done more harm to India than any previous system.”
